Rental Agreement / Hire Terms

These Hire Terms apply to all rentals supplied by TempFencing Ltd, including temporary fencing, gates, and related site security products (“Equipment”).

By renting from us, you agree to these Hire Terms.

1. Rental Period

The rental period begins on the day the equipment is delivered or installed (unless otherwise agreed).

The rental period ends when:

  • The equipment is collected by TempFencing Ltd, or

  • The hire is ended in writing, and pickup is arranged

Minimum hire periods may apply.

2. Customer Responsibilities

While the equipment is on hire, the customer is responsible for:

  • Keeping the equipment secure

  • Preventing theft, damage, or misuse

  • Ensuring equipment is not moved, altered, or removed without approval

  • Informing us immediately if equipment is damaged, missing, or moved

3. Site Access and Conditions

The customer must ensure:

  • Clear and safe access for delivery and pickup vehicles

  • Suitable ground conditions for installation

  • Any hazards are disclosed before work begins

TempFencing Ltd may refuse or stop work if conditions are unsafe.

4. Moving or Tampering with Equipment

The customer must not:

  • Move fencing panels or gates

  • Remove clamps, feet, or bracing

  • Modify or attach signage without approval

If equipment is moved without permission:

  • Safety may be compromised

  • Additional charges may apply

  • TempFencing Ltd is not liable for resulting issues

5. Loss, Theft, and Damage

The customer is responsible for any loss, theft, or damage that occurs during the hire period (fair wear and tear excluded).

If equipment is stolen or damaged, the customer may be charged:

  • Repair costs, or

  • Replacement costs, plus any associated labour and transport

6. Payment Terms

Payment terms are stated on invoices unless otherwise agreed.

Late payments may incur:

  • Additional fees, and/or

  • Suspension of service or pickup until accounts are settled

7. Pickup and Off-Hire Requests

To end a hire, the customer must request off-hire by contacting TempFencing Ltd.

Pickup timeframes depend on:

  • Scheduling availability

  • Weather

  • Site access

Hire charges may continue until the equipment is collected.

8. Liability

TempFencing Ltd is not liable for:

  • Theft or damage occurring on the customer’s site

  • Losses caused by site conditions, third parties, or weather

  • Any indirect or consequential loss (including loss of profit)

The customer is responsible for ensuring the equipment is used safely and appropriately.

Nothing in these Hire Terms limits rights under New Zealand law.

9. Health and Safety

The customer must ensure that the site remains safe for access during delivery, installation, service, and pickup.

TempFencing Ltd reserves the right to stop work if staff safety is at risk.

10. Changes to These Terms

TempFencing Ltd may update these Hire Terms at any time. The latest version will be available on our website.

11. Governing Law

These terms are governed by the laws of New Zealand.
